Smithy 3-in-1 Warranty Agreement

Smithy 3-in-1 and Stand Alone Machines are warranted for two years (unless otherwise noted) from the day the machine was shipped from our warehouse to the original purchaser against defects in materials and workmanship. During that time, Detroit Machine Tools will replace any defective parts that are returned to our warehouse, free of charge. Upon receipt of the defective parts, a Customer Service Technician will arrange with you to send replacement parts immediately. This warranty does not cover parts that are worn out through the negligence on the part of the operator nor does it cover consequential damages resulting from defects in material or workmanship.

Most warranty repairs and/or replacements are handled routinely, but sometimes requests for warranty service may not be appropriate. This warranty does not apply to defects due directly or indirectly to misuse, abuse, negligence, accidents, repairs, or lack of routine maintenance. This warranty is also void if the serial number of the machine has been removed or has been altered or modified.

In no event shall Detroit Machine Tools be liable for indirect, incidental or consequential damages from the sale or use of the product. This disclaimer applies both during and after the term of this warranty.

We do not warrant or represent that the merchandise complies with the provisions of any law or act unless Detroit Machine Tools so warrants. In no event shall Detroit Machine Tools' liability under this warranty exceed the purchase price paid for the merchandise. Legal actions brought against Detroit Machine Tools shall be tried in the State of Michigan, County of Washtenaw.

Detroit Machine Tools shall in no event be liable for death, injuries to persons or property for incidental, contingent, special or consequential damages arising from the use of our products.

This is Detroit Machine Tools’ sole warranty and any and all warranties that may be implied by law, including any merchantability or fitness, for any particular purpose, are hereby limited to the duration of this written warranty.

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusions may not apply to you.

RECEIVING YOUR SHIPMENT

When you receive your merchandise, please inspect the packaging very carefully. Read the delivery receipt carefully to ensure that you are receiving all packages listed on the receipt. If you see any damage or suspect concealed damage, please note this the delivery receipt. Be sure to also retain all original packaging. Call us at 800-476-4849 and we will do our best to help resolve the matter. Detroit Machine Tools cannot take responsibility for damage incurred to merchandise after you've signed for it as complete and in goodcondition.

SMITHY 3-in-1 RETURN POLICY

(Granite and Midas Series Machines)

We strive to ensure your total satisfaction with your new machine tool. Under the conditions of our 90-day Hands-On Trial, Granite and Midas 3-in-1 machine tools purchased directly from Detroit Machine Tools may be returned within 90 days of its ship date. If you are not fully satisfied, arrange to have the machine returned for an exchange or a full refund of the product’s original purchase price, less the standard shipping charges to and from your location, while also meeting the following criteria: 1) machine must be cleaned and in like-new condition when returned, 2) machine must also be returned in the original crate with all tooling included in the Basic or Premium Tool Pack, and 3) the price of any not cleaned, used, damaged or missing tooling will be deducted from the original purchase price.

Please Note: The 90-Day Hands-On Trial applies only to single-unit purchases. It is not transferable

and does not cover items that have been modified or damaged by abuse, usage not in accordance with product instructions, improper care, or improper maintenance.

To arrange the return or exchange of a Smithy machine, please call our Customer Service department –

800-476-4849 – within 90 days of the machine’s ship date to receive further instructions and to arrange the hassle-free pick up and return of the machine via our freight carrier.

*Effective date applies to all machines purchased after January 1st, 2014
